3. Terms and Conditions
Dear Guests
We make every effort to provide you with the best service in a pleasant and friendly atmosphere at all times. We strive for your complete satisfaction and endeavor to provide safe and secure journey without any misunderstanding between the tour escorts, company and you at any time. Please read and understand the booking condition for your holiday, before you register yourself for any tours. The ‘Terms and Conditions’ given below, on our website, the tour registration form and any other printed material, together with ‘Frequently asked questions’ and ‘How to book your tour’ on page numbers the basis of our contract with you.
General terms
1. All services provided and assured by the Company are subject to full realization of payment prior to departure. If payment to the Company is made by cheque, the Package/ tour component will be delivered only after realization of cheque.
2. The Company has right at any time and for any reason:
(a)To cancel a tour package/tour component prior to the date of departure and if it does so, its liability shall be limited to refunding all the money paid by the Tourist, towards the tour package / tour component.
(b)To amend, alter, vary or withdraw any tour, holiday, excursion or facility, it has advertised or published, or to substitute a hotel of similar class if it is deemed advisable or necessary. In either case the Company shall not be liable for any damages, additional expenses or consequential loss suffered by the Tourist/Group.
3. No person, other than the Company, in writing has authority to vary, add, amplify or waive off any description, representation, terms and conditions set forth herein or in brochure of the Company, or other terms & conditions regarding tour booked by the Tourist with the Company.
4. In the event of the Company exercising its right to amend or alter any tour advertised in their brochure or any other media after such tour or holidays has been booked the Tourist shall have right:
(a)To continue with the tour or holiday as amended or altered.
(b)To accept any alternative tour or holiday which the Company may offer. In neither of the above cases shall the Company be liable to the Tourist/Group for any damages, additional expenses and consequential loss suffered by the Tourist/Group.
5. The Company shall in no circumstances whatsoever be liable to the Tourist/Group:
(a)Any death, personal injury, sickness, accident, loss, delays, increased expenses or consequential damages by any misadventure or otherwise caused.
(b)Any act, omission or default of any hotelier, carrier, travel component supplier or other person or by any servant or agent employed by the travel component supplier who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the Tourist/Group, howsoever caused. In this clause the expression “however caused” includes negligence on the part of any person.
6. No liability on the part of the Company arising in any way out of this contract in respect of any tour, holiday or excursion facility shall exceed the total amount paid or agreed to be paid for the tour, holiday, package/ tour component or excursion, and shall in no case include any consequential damages or additional expenses whatsoever.
7. The prices quoted by the Company in its brochures / quotation are in US Dollars or equivalent in foreign currency (local currency of the foreign country / countries being visited). The Company reserves the right to amend these prices in case of currency fluctuation and changes in various rates of exchange and or fuel cost before departure, and to surcharge accordingly. All such increases in price must be paid for in full.
8. It is the responsibility of the Tourist/Group to check and hold valid travel documents like passport and Visa till the end of the tour. In case any travel document like visa is refused, expires or is cancelled by the authorities, the tour participant will have to meet all the contingencies arising therefrom and to meet all expenses consequential thereto. The Company will have no responsibility whatsoever in respect of the above matters. It is the responsibility of the Tourist/Group to check and hold valid travel documents like passport and Visa till the end of the tour. In case any travel document like visa is refused, expires or is cancelled by the authorities, the tour participant will have to meet all the contingencies arising therefrom and to meet all expenses consequential thereto. The Company will have no responsibility whatsoever in respect of the above matters.
9. The Cost of Ticket does not include any Insurance Premium. The Tourist/Group will have to pay any such premium at their own cost.
10. All tour programs and packages/ tour components are subject to laws, rules and regulation/Group are on tour and back. The Company will have no responsibility in respect of any condition brought about by any such laws, etc., or due to act of God.
11. Any complaint by the Tourist (including complaint on behalf of passengers of the Group submitted by the Tourist) in connection with or arising out of the tour must be notified to the Company in writing within twenty one (21) days from the end of the tour. No claim or complaint made thereafter shall be entertained in any circumstances. No individual complaint of passenger of the Group shall be entertained directly and therefore same must be made only by The Tourist who is a leader of the Group.
12. All claims, disputes and litigation relating to the tours arranged or co-coordinated by the Company shall be construed according to current Indian laws only and shall be subject to jurisdiction of courts in Delhi only.
13. Check in / Check out. Most hotels worldwide observe 1400-1600 Hrs. as Check-in time & 1000-1200 Hrs. as Check out time. If the Tourist/Group arrival is before or departure is after the normal check-in or check-out time, the Company is not responsible for additional charges levied by the hotel or travel component supplier and such charges are to be settled by the Tourist/Group directly with the hotel or travel components supplier.
14. The Company will not be liable to any passenger for refund, compensation or claim for shortage of tour days or for cancellation, postponement or re-routing of any particular scheduled transport service due to any reasons including fog. The rules in respect of cancellation charges or refund will be applicable. The tickets are issued, subject to conditions herein.
Tour Conditions
You will have to strictly follow the tour program and comply with the terms and conditions of the various contractors/ third party vendors such as Hotels, Airlines, Destination Management Companies, Cruise, and Insurance etc.
You are further requested to be punctual and adhere to the time-lines of the tour. In case of you not being punctual you may miss your flight, your coach and your meal etc for which you cannot claim any damage from our company.
You understand that you are traveling in the group, and you shall not behave in a manner which causes distress or annoyance to other tour participants. In case you behave in a manner which is rowdy and indecent, you may be asked to leave the group at your cost and peril.
It is understood that there shall be no refund or compensation whatsoever for unutilized services whether as a matter of choice or caused by your fault or compelled by circumstances such as ill-health, weather or any other reason.
Valid Passport and VISA
It is entirely your responsibility to ensure that you have the appropriate passport and there are sufficient number of blank pages, which is valid for at least nine months beyond your proposed return date to India with necessary VISAs and immigration clearances (whichever is applicable). Our Company reserves its right to refuse to apply your VISA after its initial screening of the documents, if it finds that the documents being supplied by you are not credible or upon any reason which the company deems fit.
Our Company shall take an appointment with the concerned embassy or with the VFS as the case may be. However, it is advisable that before you go for bio metric there is no cut, wound or mehandi applied on your hands.. Also if you being accompanied with your Children below 5 years, up to 16 years of age have certain special procedure for which we request you to please visit the VFS or Embassy site.
It is your responsibility to provide company all the additional information details and documents which you possess to support the VISA application. The company cannot be held liable for any clerical error regarding names, attachment of wrong photograph, duration, and types of VISA (Single/multiple entry) occurs in the embassy. It is your duty and responsibility to check VISA, their validity, details and the correctness thereof. All the consequences of refusal of grant of VISA is on you including the corresponding cancellation charges.
In the event of the application for VISA being made by you or the Company on your behalf, if rejected by the concerned Embassy or Authorities due to inadequate supply of documents furnished by the applicant or due to any other reason whatsoever, the Company shall not be liable or responsible for the same.
You further give your consent that if in case the passports are required to be mailed for VISA’s/POE to different cities, Company has the right to courier the same by a reputed courier agency and in case of loss or delay of the passport arising out of such transmission, Company shall not be held responsible or liable to compensate the holder for any loss whatsoever.
The position in respect of cancellation of tour by you due to non-availability of travel documents would not change only by virtue of you having applied for such documents through the Company.
In case VISA is being applied by you/passenger, it is your responsibility to check & re-check all the documents, application submitted by you in-person. You must send copy there of immediately to us through Whats App, mail, physically handing copy thereof to us or through any such means.
Hotel
Company reserves the right to change the Hotels being suggested in the itinerary as the same are always indicative to the category of the Hotels the company shall be providing not that the company is bound to provide the Hotels mentioned in itinerary. Company shall provide a Hotel with a similar category at all times.
Star classification of Hotels as 5 star, 4 star and so on is provided to the Company by the supplier of the hotel travel component and the Company endeavor to validate and authenticate this information in utter good faith. The Company cannot be held liable for wrong and inaccurate information provided to the Company. Descriptions, photographs, sketches and list of amenities/facilities are also provided and this information is obtained from the supplier of the hotel travel component.
The standard check in time for Hotels across the globe is 14:00 Hrs onwards and the check out time is 12:00 Hrs latest or before that. Hotels may not provide you breakfast on the day of check-in unless and until you have requested for an early check-in for which you have to pay additional charges.
Hotel may ask for security deposit, any damage in the hotel the cost of it will be adjusted while refunding security deposit by the hotel. Adjacent, interconnecting, king bed size, no smoke cabins may be provided, if available with the Hotel. Hotel management may charge for these requests.
Our Company shall not be held liable for the room conditions or any of its amenities. If there is any issue with any of the amenities in the Hotel rooms with respect to Wi-Fi, Air Conditioning, Security or any other such facilities, the same shall be brought to the knowledge of the Hotel management, who shall in its best effort and endeavor try to resolve the problem, if any.
Tours and Transfers
Packages : Wherever transportation is provided on basis of Seat in Coach (SIC) same is on sharing basis.
Sightseeing Tours : Transportation is provided on the basis of Seat in Coach (SIC) same is on sharing basis or Private vehicle basis depending upon the tour/tour option booked.
Airport Transfer : Transportation is provided on the basis of Seat in Coach (SIC) same is on sharing basis or Private vehicle basis depending upon the transfer/transfer option booked.
Baggage policy
Coaches have a limited space for luggage it is advisable that you travel lightweight and preferably carry only one suit case and one soft hand bag per person as it can be easily accommodated inside the coach. The ideal size of the baggage which we recommend is 158 cms (width +length +height). The ideal weight which shall be permitted in 20Kg Check-in Baggage plus 5 kg Day Pack.
We cannot be held liable for loss or any damage of the baggage during your transfers. It shall be the sole responsibility of passenger to lodge complaint with local authorities, police, hotel/ airline/DMC regarding loss or damages to the property. Since tour coordinator is to lead the group activities he will be unable to extend any personal assistance. Neither our company nor DMC can be held liable in this regard. It may be noted that insurance company, as the case may be, settle claims directly with the passenger of course in terms of insurance policy only.
Airlines
Under no circumstances whatsoever shall the Company be held liable to you or any person traveling with you for any loss of baggage being caused by the airlines, failure to provide meals of your choice by the airlines, and the Company is also not liable for any damage being caused to you by the airlines by way denying boarding of the flight due to any reason whatsoever or because of downgrading due to overbooking or if in case the airlines fails to accommodate you despite you having the confirmed ticket. The Company shall also not be responsible for quality or quantity of meals offered by the airlines and nor for flight rescheduling, flight cancellation, change of flight schedule or routing. Under all such circumstances, our company shall not be held liable for any loss/inconvenience suffered by you or by the people accompanying you. However, you shall be free to pursue your remedies against the concerned airlines at the appropriate forum at your cost and peril without making our company a party. The distance mentioned in hours is indicative of approximate time of travel which may vary as per the prevailing air traffic and weather conditions. In group tickets web-check-in may not be available. Seat allocation is not undertaken at our end as it is at discretion of airlines.
Also, please be informed, well in advance, that if there is any unusual delay or cancellation of flights or delay in landing of the Air Carrier which results into curtailment of days/nights in the tour package being booked by company, we cannot be held liable to compensate you for the said loss as the same is not in the hands of the company.
Mode / Forms of Payment
The registration amount paid while booking through – Cash/ Cheque/ Bank Transfer/Cards Payment, is a non-refundable non adjustable and interest free amount. The full amount must be received in accordance laid down in the Boucher. Passengers must clear entire billing amount of the tour atleast 15 days prior to departure date. If do not receive the payment by this date, we reserve the right to cancel the reservation.
Cancellation Policy
Company reserves its right to cancel the booking being made by you or even amend the same, if necessary without assigning any reasons thereof. Such amendment or cancellation may be due to circumstances beyond the control of the company. As per the policy of the company, the company in its best endeavors shall book alternate Hotels for you, after confirming the dates with you. However, at no point of time shall our Company shall be responsible or liable to pay any compensation or damage or any other expense or business loss suffered by you due to the cancellation or amendment of the tour package booked by you.
CANCELLATION OF BOOKING BY GUEST
In case you wish to cancel the tour package booked, you must notify us in writing through email. Only after the receipt of the same by our company staff, it shall be deemed that the said communication has been received by our company.
• If Cancellation is made any time between 0-10 day to Departure, 100% cancellation charges.
• If Cancellation is made any time between 10-15 day to Departure, 75% cancellation charges.
• If Cancellation is made any time between 15 -30 day to Departure, 50% cancellation charges.
• If Cancellation is made any time before 30 day to Departure, 20% cancellation charges.
• In case passenger is no show at the time of departure, 100% of tour cost shall be deducted.
• Cancellation charges for Star Cruises booking shall apply as per cruises cancellation rules.
• Cancellation charges for Airlines bookings shall apply as per Airlines cancellation rules.
CANCELLATION DUE TO REFUSAL OF VISA BY THE EMBASSY
Granting and rejection of VISAS is the sole discretion of embassy. Our Company only acts as a facilitator for obtaining the VISA. The company shall, under no circumstances, be held liable or responsible for rejection of VISAS and any other related incidental or consequential loss, damage, cost or expense. You are required to submit copy of VISA granted to you.
If the rejection of VISA is intimated by the embassy within the cancellation period specified above, then the cancellation charges as appearing shall be applicable. You are required to submit Refusal of VISA to us. For the purpose of ascertaining the applicable cancellation rates, the cancellation under this head will be deemed to have been made only when we receive the intimation of VISA rejection from the embassy. Subsequently, if you choose to re-apply for the VISA, then in that case the cancellation charges if any, shall be borne by you from the date of second refusal, if any. If in case we have received no intimation from the embassy of accepting of VISA application before the departure date of the tour, then in that case the maximum cancellation charges shall apply.
PROCESSING CHARGES
We hold our right to charge a processing fee which shall be 10% of Land part package cost, if booking is withdrawn by you even 5 minutes after confirmation of booking reference number being communicated to you from our end. Once confirmation is conveyed normal cancellation charges shall be applied.
